Please read these Terms of Service carefully before using any services provided by Arbiter Entertainment. By accessing or using our services, you agree to be bound by these terms. If you do not agree, do not use our services.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Arbiter Entertainment ("Arbiter," "we," "us," or "our") governing your access to and use of our websites, games, software, and related services (collectively, the "Services").
By creating an account, downloading, installing, or otherwise accessing our Services, you confirm that you are at least 13 years of age (or the minimum digital age of consent in your jurisdiction), have read these Terms, and agree to be legally bound by them. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Use of Services
Arbiter Entertainment grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services for personal, non-commercial entertainment purposes, subject to these Terms.
Our Services include, but are not limited to, the browser-based game Avero, our websites at arbiter.gg and avero.gg, community features, and any associated software or content. We may update, modify, or discontinue any part of the Services at any time, with or without notice.
User Accounts
To access certain features you may be required to create an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
- Do not share your account credentials with any third party.
- Notify us immediately at [email protected] if you suspect unauthorised access to your account.
- One account per person unless expressly authorised by Arbiter.
- Accounts created using automated means are prohibited and will be terminated.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.
Intellectual Property
All content within our Services — including but not limited to code, graphics, character designs, audio, trademarks, logos, and text — is the exclusive property of Arbiter Entertainment or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our Services without our prior written consent. Nothing in these Terms transfers ownership of any intellectual property to you.
Prohibited Conduct
You agree not to engage in any of the following while using our Services:
- Cheating, hacking, exploiting bugs, or using unauthorised third-party software to gain an unfair advantage.
- Harassing, threatening, or abusing other users.
- Impersonating any person, entity, or Arbiter staff member.
- Attempting to gain unauthorised access to any part of our systems or another user's account.
- Transmitting spam, malware, or any harmful code.
- Using our Services for any unlawful purpose.
- Reverse engineering, decompiling, or disassembling any software forming part of our Services.
- Selling, trading, or transferring your account or any in-game items outside of authorised channels.
Violations may result in immediate account suspension or permanent ban, at our sole discretion, without refund of any purchases.
Virtual Items & Currency
Our Services may include virtual currency and in-game items ("Virtual Items") that can be acquired through gameplay or purchased with real money. Virtual Items have no real-world monetary value and cannot be redeemed for cash or transferred outside of the game.
Arbiter Entertainment does not offer loot boxes or randomised gambling mechanics. All purchasable content is displayed clearly before purchase. All purchases of Virtual Items are final and non-refundable except where required by applicable consumer protection law.
We reserve the right to manage, modify, or remove Virtual Items at any time. You acknowledge that you do not own Virtual Items — you hold a limited licence to use them within the Services.
User-Generated Content
If you submit, post, or otherwise make available any content through our Services ("User Content"), you grant Arbiter Entertainment a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, and display that content in connection with the Services.
You are solely responsible for your User Content and represent that it does not infringe any third-party rights and complies with all applicable laws. We reserve the right to remove any User Content at our discretion.
Termination
You may stop using our Services at any time by deleting your account. We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms.
Upon termination, all licences granted to you will immediately cease. Provisions that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability sections.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ARBITER ENTERTAINMENT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARBITER ENTERTAINMENT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ARBITER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction where Arbiter Entertainment is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of that jurisdiction, and you waive any objection to such venue.
Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If the changes are material, we will notify you through our Services or by email. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
